Appeal Court Overturns Order, Sacks Oko-Jumbo

The Abuja Division of the Court of Appeal has overturned an order by the Rivers State High Court that had barred the 24 members of the Rivers State House of Assembly, led by Martin Amaewhule, from functioning as Assembly members.

This decision came after an appeal by Amaewhule and the 24 members against the High Court's May 10, 2024, ruling.

 Justice Jimi Olukayode-Bada, leading a three-judge panel, declared the appeal "meritorious" and struck out Victor Oko-Jumbo’s suit from the Rivers State High Court.

The appellate court ruled that the Federal High Court, not the State High Court, had jurisdiction over the matter, rendering the previous restraining order "null and void."

 The court stated that ex parte orders require genuine urgency, which was lacking in this case, and noted the importance of hearing the appellant’s position for fair adjudication.
